While willfulness impacts the availability of treble damages and attorneys fees, it impacts a lot more than that. This presentation will present statistics on the impact of Halo on patent litigation. It will look at how Judges, Juries, and Lawyers have handled issues of willfulness since Halo was decided. These realities counsel a different course of action to protect against willfulness than in the pre-Halo era.
