Sallie Mae Bank - Parus Holdings v. Sallie Mae Bank - Patent Infringement
Sallie Mae Bank in a case against plaintiff Parus Holdings regarding four patents related to computer, Internet and telecommunications based networks. Baker Botts challenged the plaintiff regarding the validity of the patents in view of the Supreme Court's Alice decision regarding patentable subject matter. In lieu of filing an answer, we filed a motion to dismiss the complaint on the grounds that the patents were directed to unpatentable subject matter. The Court granted our motion to on dismiss citing the Alice decision and ruling the patents asserted against Sallie were unpatentable. After oral argument, the Federal Circuit affirmed the ruling on a Rule 36 motion.
