DALLAS, August 18, 2023 – Baker Botts L.L.P., a leading international technology, energy and life sciences law firm, is proud to announce that it has secured a win for pro bono client U.S. Navy veteran Ramon Munoz Rosado in his successful appeal to the U.S. Court of Appeals for Veterans Claims (the “Court of Appeals”). Baker Botts represented Mr. Rosado in appealing the denial of disability benefits by the Board of Veterans’ Appeals (the “Board”).

The Board had denied Mr. Rosado’s claim for a total disability rating for compensation based on individual unemployability (“TDIU”), and Baker Botts represented Mr. Rosado at a Rule 33 Conference with counsel from the U.S. Department of Veterans Affairs (the “VA”). Baker Botts and the VA negotiated a joint disposition of the case after the VA conceded that the Board had erred by failing to comply with a prior Court of Appeals remand order. Under a Joint Motion for Remand that was approved by the Court of Appeals on June 20, 2023, the Board’s decision was vacated and Mr. Rosado’s case was remanded back to the Board for further consideration of his TDIU claim.

As a result of the victory, Baker Botts was awarded attorneys’ fees in the amount of $9,859, which will be donated to the Veterans Consortium Pro Bono Program.
