Overview

Cailyn Reilly Knapp is a senior associate in Baker Botts' Litigation group, where she represents clients in a broad range of litigation matters in federal and state courts, with a particular emphasis on complex commercial litigation, white collar defense, and antitrust. As a former law clerk in the United States District Court for the Eastern District of Virginia, Cailyn has significant experience in the "rocket docket." Cailyn's practice also includes corporate internal investigations and defending corporate and individual clients in criminal and civil enforcement matters before the Department of Justice and other federal and state agencies.

Cailyn serves on the board of directors of the Northern Virginia Chapter of the Federal Bar Association, an organization that promotes the welfare, interests, education, and professional development of all attorneys involved in federal law, including federal judges and practitioners from the public and private sectors.

Cailyn also serves on the board of directors of No Stomach for Cancer, a non-profit organization that promotes research, education, and advocacy concerning hereditary diffuse gastric cancer, a condition that has affected Cailyn and her family.

A former college lacrosse player and current youth coach, Cailyn devotes time to learning, writing, and speaking about sports law, specifically concussion regulation at the youth, NCAA, and professional levels. While attending Villanova University School of Law, Cailyn published two articles on the subject in the UCLA Entertainment Law Review and the Jeffrey S. Moorad Sports Law Journal.

Cailyn is conversant in French.

Before joining Baker Botts in November 2015, Cailyn served as a law clerk to the Honorable Anthony J. Trenga and the Honorable John F. Anderson, Magistrate Judge, of the United States District Court for the Eastern District of Virginia, known nationwide as the "rocket docket," and for its handling of national security cases. Cailyn so enjoyed her clerkships that she returned to Judge Trenga's Chambers from 2020 to 2022 to clerk again, before resuming her practice at Baker Botts in October 2022. In law school, Cailyn interned with the Honorable Thomas L. Ambro of the United States Court of Appeals for the Third Circuit, the Honorable Lynne A. Sitarski, Magistrate Judge of the Eastern District of Pennsylvania, and the Honorable Charles H. Toliver, IV, of the Delaware Superior Court.

Experience

Complex Commercial Litigation

  • Defended beverage manufacturer in multiple class actions alleging false advertising of some of America's best known and enjoyed consumer products and received favorable 49- and 1-state settlements.
  • Represented technology company in a dispute relating to an acquisition and earnout payment involving breaches of fiduciary duty, received favorable settlement.
  • Represented tool manufacturer in connection with alleged boycott of license and standard setting exclusion claims; prevailed on summary judgment.

White Collar

  • Represented individual under investigation by the SEC for alleged violations of insider trading laws.
  • Represented individuals under investigation by the Office of Special Counsel.
  • Conducted internal investigation and risk assessment focused on company compliance issues, revised existing compliance policies and procedures, and provided prospective advice regarding interactions with foreign regulators.
  • Conducted global internal antitrust investigation for international corporation in response to a Department of Justice subpoena.

Pro Bono

  • Represented an individual involved in use-of-deadly-force incident, delaying public release of name until risk assessment could be performed and concluded that name could be released with no credible threat to individual or family's safety.
  • Defended individuals against accusations of ineffective assistance of counsel.
  • Represented individual in dispute involving breach of contract relating to collection of literary royalties.
