Overview

Scott primarily focuses on midstream and LNG project development activities, including complex commercial contracts, A&D, rights-of-way, construction, operations, and joint ventures, in addition to energy regulatory (state and FERC) and litigation counseling. He also regularly advises corporate boards and committees on midstream transactions.

Scott has extensive experience with long-term commercial contracts related to gathering and pipeline transportation (including state and FERC tariffs); processing and fractionation; interconnection, compression, blending, treating, stabilization, and pumping; storage (underground and above-ground) and terminaling; commodity sales (including NAESB, ISDA and other forms), asset management, and marketing; feedstock, supply, offtake and offloading; liquefaction and terminal services; saltwater disposal; and hydrogen and CCUS.

Scott clerked for the Honorable Vanessa Gilmore of the U.S. District Court for the Southern District of Texas. Before law school, he worked as an energy analyst for Accenture.

  • Meridian LNG Holdings Corp. – negotiated and drafted a 2.0 MTPA liquefaction tolling agreement for first customer of Magnolia LNG, LLC’s LNG export terminal
  • ENSTAR Natural Gas Company – representation in numerous matters, including while seconded to company to assist with project development of first Alaskan underground gas storage utility in consortium project with electric power and gas distribution companies for increased gas supplies in Cook Inlet region
  • Excelerate Energy – drafted purchase and sale agreement for $350 million share in LNG charter company, and negotiated multiple liquefaction tolling agreements and terminal use agreements for customer of proposed LNG terminals in the USA

  • Cook Inlet Natural Gas Storage Alaska – representation during proceedings to obtain certificate of public convenience and necessity from Regulatory Commission of Alaska (RCA) for first underground gas storage utility in Alaska

  • CIMA Energy, Ltd. vs. Panhandle Eastern Pipe Line Company LP – favorable settlement for CIMA after remanding force majeure contract dispute to Texas state court
  • Spectra Energy – favorable settlement in jurisdictional dispute over filed rates on Spectra’s Algonquin Gas Transmission system in parallel litigation against Boston Generating, LLC before bankruptcy court and U.S. District Court for the Southern District of New York and parallel regulatory hearings before FERC under FPA and NGA
  • South-Wen, Inc. vs. Integrys Energy Services – favorable settlement for Integrys in Texas state court contract dispute after plaintiff’s regulatory class action claims on summary judgment were denied
  • Energy trading company – favorable settlement in Texas state court contract dispute after motion to dismiss was denied on jurisdictional grounds
