Foreign Direct Investment Controls and Oversight in the U.S., EU, and across the Globe
The last few years have seen a clear up-tick in initiatives to strengthen governmental oversight of foreign direct investment (FDI). The U.S. has intensified the CFIUS regime, the EU has created a coordination and oversight regime for national FDI controls, and numerous other countries around the world are taking similar steps to protect vital strategic assets from foreign takeover.
The current COVID-19 crisis has brought these efforts into sharper focus – with new and strengthened initiatives to protect the ‘sovereignty’ of the healthcare sector and related R&D assets and calls to protect strategic sectors from “predatory” acquisitions by foreign investors.
A transatlantic team of Baker Botts lawyers will explore these developments in the U.S., EU and across the globe and discuss what they mean for transactions and FDI.
Speakers include Matthew Levitt, David Gabathuler, Matthew West and Jason Wilcox
