Codes of Conduct and Middle Eastern Arbitral Practice
Speeches & Presentations
Does international arbitration have a problem when it comes policing counsel, arbitrator or expert behaviour? Have any of the codes of conduct that have been added to various rules made a noticeable impact? In this session, a panel of leading names will review whether efforts to stamp out some of the excesses of the recent past are having any effect. If not, what might, and what would be most helpful in the context of the Middle East? In addition, the panel will introduce and discuss scenarios based on examples of ethical issues before asking the audience and other panellists to vote on how they would respond.
The panel will discuss:
- Effect of existing professional conduct codes.
- Arbitrators’ powers to sanction counsel.
- A party-appointed-arbitrator: reconceptualizing the meaning of impartiality.
- Expert witnesses: a new Achilles heel?
- Moderator: Paul Key KC, barrister, Essex Court Chambers
