Recent SCOTUS Cases and Energy Enforcement
Baker Botts Partner David Applebaum served as Moderator on the panel regarding "Recent SCOTUS Cases and Energy Enforcement" for the Energy Bar Association's Compliance and Enforcement Steering Committee. Details on the panel are noted below.
A panel of experts will discuss, demystify and debunk what the Loper Bright, Jarkesy, Corner Post and Axon decisions from the U.S Supreme Court mean for FERC's and other energy regulators’ enforcement programs. Lawyers from all over the country and in all sorts of practices are talking about this flurry of decisions, but THIS program will focus specifically on what they means (and equally importantly what they do NOT mean) for federal energy enforcement law.
A panel of experts, who have worked at FERC in enforcement, in energy enforcement in private practice, or both with real world experience with the relevant statutes, regs and court cases, will delve into the real meaning of these decisions and make well-informed predictions about how the agencies, the bar, the courts – and maybe even Congress – will react.
