Baker Botts hosted a webinar on Thursday, April 23 to discuss the court's decision to vacate, remand and enjoin Nationwide Permit 12 (NWP 12). NWP 12 is used extensively to obtain Clean Water Act permit coverage for a wide variety of pipeline projects that involve disturbance of wetlands and other waters of the United States.

During the webinar we discussed:

• The immediate implications for projects that currently rely on Nationwide Permit 12

• Longer-term considerations including alternatives to Nationwide Permit 12 (e.g., obtaining individual Clean Water Act permits)
