Daily Journal Names Guske, Guy and Lamkin 2024 ‘Top Intellectual Property Lawyers’

Palo Alto/San Francisco, May 23, 2024 – Baker Botts L.L.P., a leading international technology, energy and life sciences law firm, is pleased to announce that the Daily Journal named Bay Area partners Sarah Guske, G. Hopkins Guy, and Rachael Lamkin to its list of “Top Intellectual Property Lawyers” for 2024.

This list is compiled from hundreds of nominations submitted by lawyers in California, with the editors selecting nominees based on the impact of their work in intellectual property.

The publication highlighted Guske’s work representing Chime Financial Inc., which joined with Meta to sue two Nigerian-based fraudsters who ran phishing attacks to attempt to gain access to accounts. Guske, who is based in San Francisco, and the team obtained a default judgment and a permanent injunction that barred the defendants from accessing the social networks and from using Chime’s trademarks.

Guy, based in Palo Alto, was singled out for convincing a federal judge in Utah to reverse a $469 million jury award in favor of ClearPlay Inc. against his client, DISH. During the trial, Guy and team began drafting a judgment as a matter of law motion. Less than two weeks after the jury rendered its verdict, the judge granted DISH’s JMOL motion, finding that DISH had not infringed ClearPlay’s patents and wiping away the $469 million damages award. The judge stated that he had never in his decades on the bench granted JMOL under Rule 50(a), but was compelled to do so in this instance due to the briefing. The ClearPlay verdict and reversal was the largest patent infringement case of 2023.

San Francisco-based Lamkin, who joined Baker Botts in June 2023, was lauded by the Daily Journal, in part, for her long-time success in strategically defeating NPEs. For example, in one recent representation of Netflix, Lamkin persuaded U.S. District Judge Jon S. Tigar to award Netflix a preliminary injunction against an NPE to prevent a fraudulent transfer of patents to a second entity, enjoining a “shell game” allegedly designed to avoid an attorney fee award. The fraud-based counterclaims and fee request on behalf of Netflix are scheduled for trial in September.
