Overview

Kurt Pankratz is a first chair trial lawyer with decades of experience in high-stakes patent and trade secret disputes. Kurt's recent successes include a $210 million trade secret verdict against a competitor (the largest trade secret verdict of 2023), an almost $300 million verdict for a patent owner, an ITC exclusion order against several competitors (leading to a $75 million settlement in addition to other, confidential settlements), and a directed verdict for a defendant. In addition to his busy trial docket, Kurt also serves as the Chair for Baker Botts' Dallas Intellectual Property Department.

Kurt regularly handles cases in both federal and state courts and particularly enjoys cases that involve high-tech issues, where he can bring to bear his early experience and background in technology. Prior to his legal career, Kurt cut his teeth as an engineer working on classified government projects involving high-security networks, signals intelligence, and technology to enable creation and modification of secure physical documents.

Kurt's experience in industry and underlying engineering skills, coupled with his decades of legal experience, give him a strategic perspective that helps him take complex issues and make them accessible and understandable. As one of Kurt's clients explained: he "handles himself very well on his feet in court and has the ability to explain intricate details to a lay person." (Chambers USA, 2018).

Kurt excels at creative, early-stage solutions. He has negotiated deals on behalf of clients -- both for intellectual property rights holders and defendants -- for amounts totaling more than even the verdicts that he has achieved. In addition, he helps strategically craft and implement intellectual property protection programs for companies ranging in size from small start-ups to multinational corporations.

In addition to his current service as Department Chair for Dallas IP, Kurt previously served as the hiring partner for the Dallas office of Baker Botts.

  • On behalf of a U.S.-based IT services and consulting company, obtained a $210M trade secret verdict (the top trade secret verdict of 2023) against a competitor.
  • On behalf of a leading media and communications company, obtained a directed verdict wiping out billions of dollars of exposure in a patent infringement lawsuit after conclusion of a two-week trial.
  • Represented a storied U.S. company in assertion of its foundational patents against a foreign competitor and obtained a $279 million verdict.
  • Represented a U.S. media company at the ITC in assertion of foundational patents regarding streaming technology. Obtained an ITC exclusion order against multiple respondents.
  • Represented a multi-national electronics company in assertion of its portfolio of patents covering WiFi, Blu-ray, digital audio, laser diode, and semiconductor manufacturing process technologies. Obtained summary judgment of infringement in one case and a jury verdict of willful infringement in a second trial.
  • Represented telecommunications equipment provider in defense of multi-patent lawsuit by competitor. Obtained jury verdict of non-infringement for all asserted patents.
  • Represented a multinational telecommunications service provider in defense of a multi-district patent infringement campaign asserting a portfolio of LTE-related patents. Obtained dismissals of all cases based on summary judgments.
  • Represented telecommunications equipment provider in assertion of patents against competitor. Obtained jury verdict of infringement for all patents.
  • Represented global handset provider in patent infringement action involving five patents directed to various network and device protocols. Obtained jury verdict of non-infringement.
  • Represented a medical device manufacturer in asserting theft of trade secrets and patent infringement against a competitor in the field of neurostimulation pulse generators and implantable leads. Obtained favorable settlement shortly before trial.
  • Represented an international software services company in defense of a patent infringement claim related to remote control computer technology. Obtained summary judgment of non-infringement for all asserted patents.
  • Represented global communications company in patent infringement action involving four patents directed to network-based multimedia services. Obtained stipulation of non-infringement after claim construction.
  • Led defense of massive patent assertion campaigns against multinational networking equipment company.
  • Helped craft global patent strategy for a Fortune 100 company.
