Baker Botts Secures Another Victory for DISH in Patent Dispute

Baker Botts L.L.P., a leading international law firm, secured a major victory for clients DISH Network L.L.C. and Sling TV L.L.C. in a patent infringement dispute before the United States Court of Appeals for the Federal Circuit. This is the second appellate victory Baker Botts has achieved for Sling TV regarding this same patent.

The patent case was brought by Uniloc 2017 LLC, a non-practicing entity that has won several trial verdicts in the past. The Baker Botts team filed IPRs challenging the validity of Uniloc’s patents at the PTAB. The PTAB invalidated two of Uniloc’s patents, but the PTAB ruled that one of Uniloc’s patents, which relates to audiovisual presentations, was not invalid. Sling TV appealed that decision to the Federal Circuit. In its decision, the Federal Circuit vacated that decision and remanded to the PTAB to reconsider its ruling. On remand, the PTAB found all challenged claims unpatentable in view of the Federal Circuit’s guidance. Uniloc appealed the PTAB’s latest ruling, but the Federal Circuit affirmed the PTAB’s finding of invalidity.

The case is Sling TV L.L.C. v. Uniloc 2017 LLC, case number 21-1651, in the United States Court of Appeals for the Federal Circuit.
