WASHINGTON, D.C., March 22, 2023 – Baker Botts L.L.P., a leading international law firm, secured a major victory for clients DISH DBS Corp. DISH Technologies, L.L.C., and Sling TV L.L.C in a patent infringement dispute before the U.S. International Trade Commission.

In its Final Determination, the ITC issued limited exclusion orders and cease and desist orders prohibiting the unlicensed importation and distribution of fitness devices, streaming components thereof, and systems sold by Peloton and Icon Health & Fitness subsidiary iFit. This streaming technology, which is protected by several patents, was first developed by a company that DISH acquired and integrated into its Sling TV brand. The patents upon which the remedial orders were granted are U.S. Patent Nos. 10,469,554; 10,469,555; and 10,757,156.

The ITC’s decision also terminated respondents lululemon athletica inc. and MIRROR from the investigation on the basis of a settlement agreement.

The case is In the Matter of Certain Fitness Devices, Streaming Components Thereof, and Systems Containing Same, Investigation No. 337-TA-1265.

The firm also obtained another victory for DISH, where a federal judge ruled that the company had not infringed on Clearplay’s patents, negating a previous patent infringement verdict of nearly $470 million.
